These Terms & Conditions apply to all bookings and services provided by Tawja Surf Morocco.
In these Terms & Conditions, “Tawja Surf Morocco”, “Tawja”, “we”, “us” or “our” refers to Tawja Surf Morocco and its owners, employees, instructors, guides and representatives.
“Guest”, “customer”, “you” or “your” refers to any person who books, participates in or uses accommodation, surf lessons, surf guiding, transfers, excursions or any other service provided by Tawja Surf Morocco.
By making a booking with Tawja Surf Morocco, you confirm that you have read and accepted these Terms & Conditions.
1. Health, Surfing & Safety
Surfing and other activities offered by Tawja Surf Morocco involve inherent risks, including falls, collisions, changing ocean conditions, currents, rocks, reefs and other natural hazards.
By participating in our activities, you confirm that you are physically and mentally able to participate and that you understand and accept the inherent risks associated with surfing and other activities.
You must inform us before arrival or as soon as possible during your stay about any medical condition, injury, medication, allergy, dietary requirement or other circumstance that may affect your ability to participate safely.
Our surf instructors and guides will provide safety instructions and advice based on the conditions and your level. Guests must follow all instructions given by our instructors and guides and must act responsibly towards themselves, other guests, our team and other people in the water.
Surfing conditions are naturally unpredictable. We may change, postpone or cancel a surf session if, in our reasonable judgment, the conditions are unsuitable or unsafe.
Tawja Surf Morocco will take reasonable care to provide activities in accordance with the services booked and to select suitable locations based on the conditions and the participant's level. However, we cannot guarantee specific waves, weather conditions, surf spots or surfing results.
Guests are responsible for taking reasonable personal precautions, including staying hydrated, using appropriate sun protection and informing our team if they feel unwell or unsafe.
2. Surf Equipment
When surfboards, wetsuits or other equipment are provided by Tawja Surf Morocco, guests are expected to use the equipment responsibly and follow the instructions given by our team.
Normal wear and tear is not charged to guests.
Guests may be held responsible for loss or damage caused by negligence, misuse, intentional damage or failure to follow instructions.
If equipment is lost or damaged in circumstances for which the guest is responsible, Tawja Surf Morocco may charge the reasonable repair or replacement cost. The amount will be based on the actual cost of repair or, where repair is not reasonably possible, the reasonable replacement value of the equipment.
3. Booking & Payment
A booking becomes confirmed once:

the required deposit has been received; and
-
the booking information requested by Tawja Surf Morocco has been completed.
The remaining balance is payable upon arrival, unless otherwise agreed in writing.
Payment of the remaining balance may be made in cash in euros or Moroccan dirhams, or by another payment method expressly agreed with Tawja Surf Morocco.
Prices and services included in a booking are those confirmed at the time of booking.
4. Cancellation & Refund Policy
If you cancel your booking more than 30 days before your scheduled arrival date, Tawja Surf Morocco will provide a full refund of all amounts paid for the booking.
If you cancel your booking 30 days or less before your scheduled arrival date, the amount already paid will be non-refundable.
If a guest arrives late, leaves early or is unable to participate in activities during their stay due to illness, injury, personal circumstances or other reasons, no refund will normally be provided for unused services.
We strongly recommend that guests take out appropriate travel, cancellation and medical insurance, including insurance that covers surfing and other activities planned during the stay.
Nothing in these Terms & Conditions excludes or limits any rights or remedies that cannot legally be excluded under applicable law.
5. Surf Conditions & Changes to Activities
Surfing depends on natural conditions and we cannot guarantee particular waves, weather, tides or surf conditions.
If conditions are unsuitable for a planned surf session, we may modify the location, timing or format of the activity in order to provide a suitable and safe alternative where reasonably possible.
No refund is automatically due solely because the waves are smaller, different from expected or not suitable for a guest's preferred level of surfing.
If Tawja Surf Morocco is unable to provide a booked activity because of circumstances within our reasonable control, we will make reasonable efforts to provide an appropriate alternative or, where appropriate, discuss an alternative arrangement with the guest.
6. Changes to Bookings
Requests to change booking dates, room arrangements, activities or packages must be made as early as possible.
Changes are subject to availability and may result in a change in price.
Tawja Surf Morocco will make reasonable efforts to accommodate requested changes but cannot guarantee that every change will be possible.
In exceptional circumstances, we may need to make changes to accommodation or activities. Where this happens, we will make reasonable efforts to provide an equivalent or, where possible, higher-standard alternative.
7. Accommodation & House Rules
Guests are expected to treat Tawja Surf Home, its rooms, furniture, equipment and shared spaces with care and respect.
Guests are also expected to respect other guests, neighbours and members of the Tawja team.
Tawja Surf Morocco reserves the right to ask a guest to leave the accommodation or discontinue participation in activities if the guest behaves in a seriously disruptive, threatening, violent or abusive manner, repeatedly disregards safety instructions, causes intentional damage or seriously interferes with the enjoyment or safety of other guests.
In such circumstances, any refund will be considered on a case-by-case basis, subject to applicable law.
Guests may be responsible for reasonable costs resulting from damage caused by their negligence, misuse or intentional actions.
8. Personal Belongings
Guests are responsible for their personal belongings during their stay and while participating in activities.
Tawja Surf Morocco cannot guarantee the security of personal belongings and is not responsible for loss, theft or damage except where responsibility cannot legally be excluded.
We recommend that guests keep valuable items secure and avoid bringing unnecessary valuables to the beach or surf sessions.
9. Photos & Videos
During your stay, Tawja Surf Morocco may take photographs or videos of surf sessions, activities, events and life at the surf house for documentation and marketing purposes.
We will respect your privacy and will not knowingly use identifiable images of you for promotional purposes where you have expressly told us that you do not consent to such use.
If you do not want photographs or videos showing you to be used for promotional purposes, please inform us before or during your stay.
Where required by applicable law, we will obtain the appropriate consent before using identifiable images for promotional purposes.
10. Personal Data & Privacy
Tawja Surf Morocco processes personal information provided by guests for purposes including:

processing and managing bookings;

communicating with guests;

providing accommodation and activities;

arranging transfers or other requested services;

fulfilling administrative and legal obligations; and

improving our services and website.
We only collect and use personal information that is reasonably necessary for these purposes.
Personal data will be handled in accordance with applicable Moroccan data-protection legislation, including Law No. 09-08, and applicable data-protection requirements relating to the processing of personal data. The Moroccan CNDP states that personal-data processing must have a defined and legitimate purpose, be proportionate to that purpose, be appropriately secured and respect the rights of the individuals concerned.
We do not sell guests' personal information.
Depending on the services used by Tawja Surf Morocco, certain information may be processed by trusted service providers, such as booking, payment, website hosting, communication or email providers, where this is necessary to provide our services.

11. Website & Cookies
Our website may use cookies and similar technologies to ensure that the website functions correctly, understand how visitors use the website and improve our services and marketing.
Where required, we will request the appropriate consent before using non-essential cookies or similar technologies.
Information collected through website analytics may include technical information such as browser type, device information, pages visited and approximate usage statistics.
12. Third-Party Services
Tawja Surf Morocco may use third-party providers for services such as online bookings, payments, website hosting, email communication, analytics, transportation or other services requested by guests.
Where a third-party service is used, the third party may process certain personal information in accordance with its own terms and privacy policy.
13. Travel Insurance
Guests are strongly advised to obtain comprehensive travel insurance before travelling to Morocco.
Insurance should, where applicable, cover:

medical treatment;

accidents and emergency assistance;

surfing and other activities;
-
travel cancellation or interruption;
-
lost, stolen or damaged belongings; and
-
repatriation or evacuation.
Guests are responsible for ensuring that their insurance covers the activities they intend to participate in.
14. Force Majeure
Tawja Surf Morocco will not be responsible for failure or delay in providing services where this results from circumstances beyond our reasonable control.
Such circumstances may include, for example, extreme weather, dangerous ocean conditions, natural disasters, government restrictions, strikes, transport disruptions, serious infrastructure failures, public emergencies or other circumstances that could not reasonably have been prevented.
Where such circumstances occur, we will make reasonable efforts to communicate with affected guests and find an appropriate solution.
15. Liability
Tawja Surf Morocco will take reasonable care in providing its accommodation and activities.
Guests acknowledge that surfing and ocean activities involve inherent risks that cannot be completely eliminated, even when appropriate safety measures are followed.
Nothing in these Terms & Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by applicable law, Tawja Surf Morocco is not responsible for loss or damage resulting from a guest's failure to follow safety instructions, negligent or reckless behaviour, misuse of equipment or violation of these Terms & Conditions.
16. Complaints
If you experience a problem during your stay, please inform a member of the Tawja team as soon as possible so that we have a reasonable opportunity to resolve the issue during your stay.
We encourage guests to raise concerns promptly rather than waiting until after departure.

17. Applicable Law
These Terms & Conditions are governed by the laws applicable in the Kingdom of Morocco, subject to any mandatory consumer-protection or other legal rights that may apply to the guest.
Nothing in these Terms & Conditions is intended to deprive a consumer of mandatory rights provided by applicable law.
18. Changes to These Terms & Conditions
Tawja Surf Morocco may update these Terms & Conditions from time to time, for example where our services or legal requirements change.
The version applicable to a booking will generally be the version in force when the booking is confirmed, unless a later change is required by law.
